Policy

Swim Express specializes in arranging swim coaches and lifeguard to travel for at-home swim lessons or swim lessons at the community or clubhouse pool. Read more about our policy for weather cancellations, etc. Swim lessons focus on drowning prevention, water survival, swimming techniques, swim team preparation, life fitness skills. Swim lessons can be arranged as group lessons or private lessons. Lifeguards are available for private pool parties or event

 
 
 

Release of Liability, Assumption of Risk & Medical Treatment (Read Carefully)

Acknowledgment & Signature

By enrolling in, participating in, or otherwise utilizing any services provided by Swim Express LLC—including but not limited to swim lessons, lifeguard services, aquatic instruction, and related activities—you acknowledge that you have read, understood, and voluntarily agree to be bound by the following Release of Liability and Assumption of Risk.

If the participant is under 18 years of age, this agreement must be signed by a parent or legal guardian, who acknowledges and agrees to all terms on behalf of the minor participant.

The waiver may be signed electronically. By signing electronically through the Wellness Living platform, the parent, guardian, or participant acknowledges and agrees that this electronic signature has the same legal effect as a handwritten signature.

Parental Responsibilities:

  • Parents or guardians are responsible for the supervision and safety of their child before and after lessons.

  • Parents or guardians must disclose any allergies, medical conditions, or medications that could impact participation in swim lessons or lifeguard services.

Inherent Risks

I acknowledge that swimming and water-related activities carry inherent risks, including but not limited to drowning, slipping, collisions, and other water-related injuries that may result in serious injury or death. I further acknowledge that these risks may be present at private residences or third-party aquatic facilities not owned, operated, maintained, or supervised by Swim Express LLC.

Assumption of Risk

Participation is voluntary, and I choose to participate despite these risks. I voluntarily assume all risks associated with participation in services provided by Swim Express LLC, including swim lessons, lifeguard services, aquatic instruction, and related activities, and accept any risk of damage to myself, my child, or others while participating.

Release of Liability

I release and hold harmless Swim Express LLC, its owners, employees, agents, and contractors from any and all liability, demands, claims, and causes of action whatsoever, including those arising from the ordinary negligence of Swim Express LLC, related to any loss, damage, or injury, including death, that may be sustained by the participant while participating in or utilizing services provided by Swim Express LLC or en route to or from such premises. I agree that I will not sue Swim Express LLC or its contractors/operators for any consequence, which includes injury, illness, and/or death of myself, my child, or anyone with whom I come into contact.

Medical Treatment & Safety

I give permission to Swim Express LLC, its owners, and contractors/operators to seek medical treatment for the participant in the event a parent or guardian cannot be reached. I agree to disclose all physical or mental conditions, restrictions, or problems that could affect participation. For the safety of all participants, Swim Express LLC reserves the right to deny participation or terminate lessons when deemed necessary, including if a participant is sick, has a contagious condition, or has not disclosed relevant medical information. I understand that Swim Express LLC is taking safety protocols, such as sanitizing equipment, as a precaution, and I agree to notify Swim Express LLC of any absence due to illness within a reasonable time.

Payment for Services

I agree to purchase passes or pay for services once my appointments have been booked or I have enrolled in any services provided by Swim Express LLC, including but not limited to swim lessons, lifeguard services, aquatic instruction, and related activities. I understand that for a Seasonal Swim Pass (Package of 10 Sessions), I may request an installment plan of 2 equal payments.

Payments may be made through the Swim Express online store or alternatively by check, cash, Zelle, or through online platforms such as Step Up for Students. I will notify the Swim Express Scheduling Specialist of my chosen payment method and provide payment in full to the assigned Swim Express instructor or lifeguard at the first session. Checks should be made payable to “Swim Express LLC” and placed in an envelope with the participant’s first and last name clearly indicated. Swim Express LLC is PCI compliant, ensuring that all online and card payments are processed securely.

Unpaid sessions or outstanding balances may prevent participation in future lessons until payment is received.

Swim passes are issued for the individual participant only and may not be shared with other participants. Passes may be transferred to another individual only after the original participant has completed their program.

I understand and agree that Swim Express LLC does not offer refunds, as all payments support staff and program costs.

Photo & Video Release

For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby grant Swim Express LLC permission to use my child’s likeness in photographs or video recordings in any and all of its publications, including but not limited to printed and digital media. I understand and agree that any photograph or video recording using my child’s likeness will become the property of Swim Express LLC and will not be returned.

I acknowledge that my participation with Swim Express LLC is voluntary and that I will receive no financial compensation.

I hereby irrevocably authorize Swim Express LLC to edit, alter, copy, exhibit, publish, or distribute these photos or videos for purposes of publicizing Swim Express LLC’s programs or for any other related, lawful purpose. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my child’s likeness appears. I further waive any right to royalties or other compensation arising out of, or related to, the use of the photographs or video recordings.

I acknowledge and agree that once photographs or video recordings are taken and used by Swim Express LLC:

  • They cannot be deleted, removed, or returned.

  • Swim Express LLC is under no obligation to remove them from any current or future publications or materials.

  • Photos and videos may appear online or on social media.

  • Photos and videos may be used indefinitely unless otherwise requested in writing.

I acknowledge that I may request that photos and videos of my child not be captured or recorded from the date of my email request sent to Swim Express LLC: https://www.swimexpressfl.com/contact-us-sign-up.

I hereby hold harmless, release, and forever discharge Swim Express LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf may have by reason of this authorization.

Privacy Policy & Opt-in Consent

I have read and agree to the Swim Express Privacy Policy and Terms & Conditions. 

I consent to be contacted by Swim Express LLC via email, phone call, or text for customer support, service information, scheduling details, and to receive opportunities, offers, and updates exclusively available to Swim Express customers. Contacts may come from (954) 247-1219 or directly from Swim Express coaches or lifeguards at (754) 247-1530. Message and data rates may apply. Message frequency may vary.

For assistance, I may text HELP to either number. To opt out, I may reply STOP at any time or click the unsubscribe link in emails.

I understand that Swim Express LLC uses Wellness Living as a third-party platform for scheduling purposes. Wellness Living’s privacy practices may be viewed here:Privacy Policy of Wellness Living Inc.

Attendance & Cancellations

I will make every effort to attend lessons consistently to support my participant’s progress. I understand that participants arriving late may have their lesson time shortened, and Swim Express LLC is not responsible for making up lost time.

Instructor or Lifeguard Cancellations

I agree to be contacted by the instructor or lifeguard using the contact information provided in my client portal. I acknowledge that the instructor or lifeguard may notify me of a cancellation within 30 minutes of the scheduled lesson (e.g., due to inclement weather). “Weather cancellations” on the day of a session are determined at the discretion of the instructor or lifeguard. If a session is cancelled by the instructor or lifeguard, the swim pass for that session will remain valid for future use.

I understand that if only one participant is scheduled for a Swim Together Group or Swim Together Class, the session may be cancelled. If desired, I may purchase a pass for a private lesson and schedule a session for my participant.

Participant Cancellations

If I cannot attend a scheduled lesson, I agree to cancel the appointment via the Client Web Portal or Achieve App at least 24 hours prior; otherwise, the swim pass for that lesson will be forfeited. No make-up passes will be provided for late cancellations (within 24 hours of the session). If the participant does not show up, the session will be considered a “no-show” and the swim pass will be forfeited.

All remaining swim passes must be used by their expiration date. Unused swim passes will be relinquished after expiration. Swim pass details, including expiration dates, may be reviewed in the Client Web Portal or Achieve App.

For Seasonal Swim Pass holders with a consistent weekly time slot: If the participant cancels three weekly sessions within a four-week period, the participant may be removed from the priority booking list for the next swim season, unless a doctor’s note is submitted to a Swim Express Scheduling Specialist explaining a medical leave.

I understand and agree that no refunds will be issued for cancelled sessions.

Grace Pass for Emergencies

For swim lessons only, in the event of illness or a family emergency, participants may receive one complimentary “grace pass” if a session must be cancelled within 24 hours of the scheduled lesson. This pass may be applied to a future swim lesson. The instructor or lifeguard will still be paid for the cancelled session, ensuring fair compensation for their time and preparation. Additional late cancellations will be subject to the standard cancellation policy, and no additional grace passes will be issued.

Pool & Swim Attire

Pool Temperature (Cooler Months):

  • To ensure the health and comfort of myself or my child, I agree to maintain the pool temperature at 85°F or warmer during cooler months.

  • I will monitor the pool temperature, and if the outside temperature is below 70°F and the pool temperature is below 85°F, I will cancel the session via the Client Web Portal at least 24 hours prior.

  • I understand that if the pool is too cold for the participant’s health, the session will be forfeited.

Pool Cleanliness:

  • If a home or private pool is used for swim lessons, I am responsible for maintaining safe chlorine levels and keeping the pool clean and sanitary.

  • If the pool does not meet water safety standards, the session will be forfeited. Alternatively, I may arrange a different pool location if the schedule allows.

Swim Attire:

  • All participants must wear proper swim outfits designed for swimming.

  • During cooler months, a long-sleeve wetsuit may be recommended for younger children but is not required. Recommended brands include O’Neill or Neoprene Wetsuits. Swim Express LLC is not affiliated or sponsored by these brands.

  • Young children who are not yet trained to use the restroom must wear two swim diapers under their swim suit.

  • Hair ties or swim caps are recommended for children with long hair to prevent hair from obstructing vision.

  • Goggles are recommended for more advanced swimmers. Recommended brands include TYR or SPEEDO. Swim Express LLC is not affiliated or sponsored by these brands.
